These Terms cover the marketing Site only. Access to and use of the S.W.A.R.M. platform/product is governed by a separate written agreement (e.g., a Master Services Agreement, Order Form, and Data Processing Addendum). Nothing on the Site is an offer to provide the product except as set out in such an agreement.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your internal, informational purposes. All rights not expressly granted are reserved.

You agree not to:

• Use the Site unlawfully or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, accounts, or systems.
• Interfere with or disrupt the Site (e.g., scraping at scale, DDoS, injecting malware).
• Reverse engineer, copy, or create derivative works from the Site except as permitted by law.
• Misrepresent your identity or affiliation, or infringe others' rights.

The Site and its content — including text, graphics, logos, the S.W.A.R.M. name and marks, and software — are owned by us or our licensors and protected by intellectual-property laws. “S.W.A.R.M.” and related marks are trademarks of [LEGAL ENTITY]. You may not use them without our prior written permission.

If you submit information through the Site (e.g., a demo request) or send us feedback, you grant us a non-exclusive, royalty-free license to use it to respond to you and improve our offerings, and you represent that you have the right to provide it. DATA SYSTEMS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED [USD AMOUNT, e.g. $100]. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless S.W.A.R.M. Data Systems from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms.
