This Privacy Policy explains how [LEGAL ENTITY](“S.W.A.R.M. Data Systems,” “we,” “us”) collects, uses, discloses, and protects personal information when you visit swarmdatasystems.com(the “Site”). It also describes the rights you may have under U.S. state privacy laws and, where applicable, the EU/UK GDPR.
1. Scope & who we are
This policy covers personal information processed through the Site. It does not cover the separate S.W.A.R.M. product/platform offered to business customers, which is governed by the agreement (e.g., a Master Services Agreement and Data Processing Addendum) between us and that customer. For product data, the business customer is generally the “controller” and we act as a “processor / service provider.”

2. Information we collect (Notice at Collection)
We aim to collect the minimum necessary. Today, the Site is a largely static marketing site with no advertising or analytics trackers. We may collect the following categories:
- Information you submit — if and when you use a form (e.g., to request a demo), we collect the identifiers and contact details you provide, such as name, work email, company, phone (optional), team size, and any message. (Note: demo and login forms are currently illustrative previews and do not transmit data; this section describes processing once they are activated.)
- Communications — if you email, call, or text us, we receive your message and contact details.
- Consent records — if you opt in to receive text messages or calls, we retain a record of that consent (the mobile or phone number, the language you agreed to, and the date, time, and method of opt-in), plus any later opt-out, so we can honor your choices and demonstrate compliance. - Essential device/usage data — standard server logs (e.g., IP address, browser type, pages requested, timestamps) generated by our hosting provider for security and reliability.
- Essential local storage — a single session-only flag (
swarm-intro-seen) so the assistant intro does not replay; it is cleared when you close your browser tab. See our Cookie Policy.
We do not knowingly collect Social Security numbers, precise geolocation, biometric data, or other sensitive personal information through the Site, and we do not use it for targeted advertising.
3. How we use information
- Respond to your inquiries and schedule or deliver demos you request.
- Contact you by email, phone, or text message about your request — and, only where you have separately opted in, send you marketing or promotional texts and calls.
- Operate, secure, maintain, and improve the Site.
- Detect, prevent, and address fraud, abuse, or technical issues.
- Comply with legal obligations and enforce our terms.
We do not sell your personal information, and we do not “share” it for cross-context behavioral advertising (as those terms are defined under the CCPA/CPRA and similar laws).
4. Text messages & phone calls (opt-in and opt-out)
We contact people by text message (SMS/MMS) and by phone only in the ways described below. Providing a phone number and agreeing to receive texts or calls is never a condition of purchase or of any service.
Text (SMS) messaging — how you opt in
We send text messages only to a mobile number you give us and for which you have provided prior express written consent — for example, by checking an unchecked consent box on one of our forms, or by texting a keyword we publish to our number. The consent language on the form tells you what kind of messages you are agreeing to receive. Consent is specific to S.W.A.R.M. Data Systems; we do not obtain consent on behalf of anyone else.
- Message frequency varies based on your request and your account activity.
- Message and data rates may apply, depending on your mobile plan and carrier.
- Mobile carriers are not liable for delayed or undelivered messages.
- Text messaging is not a secure channel — please do not send sensitive personal information by text.
How to stop texts
Reply STOP to any message from us to opt out at any time. We will send one confirmation message and then stop, unless you opt in again. Reply HELP for help, or email support@swarmdatasystems.com. Opting out of texts does not opt you out of transactional email or other channels; tell us if you want those stopped too.
We do not sell or share your mobile number or SMS consent
No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent are not shared with any third parties, except with the messaging providers and carriers acting on our behalf strictly to deliver the messages you asked for.
Phone calls
We call the number you provide to respond to your request or service your account. Where the law requires it, we obtain prior express written consent before placing marketing calls or texts using an automatic telephone dialing system or an artificial or prerecorded voice, including calls placed with AI-assisted voice agents. We identify ourselves at the start of the call and provide a way to opt out.
- You can opt out on any call by telling the representative or agent to place you on our internal Do Not Call list, or by emailing us — we honor the request across our systems.
- We maintain an internal Do Not Call list and honor the National Do Not Call Registry and applicable state registries.
- Calls may be monitored or recorded for quality, training, and compliance. Where consent is required, we disclose this at the start of the call and obtain consent before recording.
Withdrawing consent
You may withdraw consent to texts or calls at any time — reply STOP, tell us on a call, or email support@swarmdatasystems.com with the number to remove. We process opt-outs promptly and, in any event, within the period required by law. We retain a record of the opt-out itself so we can continue to honor it.
7. Your privacy rights
Depending on where you live (e.g., California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws), you may have the right to:
- Know/access the personal information we hold about you and how we use it.
- Delete personal information, subject to exceptions.
- Correct inaccurate personal information.
- Obtain a portable copy of your information.
- Opt out of sale, sharing, or targeted advertising (we do none of these).
- Opt out of marketing communications at any time, including text messages (reply STOP) and phone calls (ask to be added to our internal Do Not Call list).
- Limit the use of sensitive personal information (we collect none via the Site).
- Not receive discriminatory treatment for exercising your rights.
- Appeal a decision on your request.
How to exercise your rights
Email support@swarmdatasystems.com with your request. We will verify your identity (and an authorized agent’s authority, if applicable) and respond within the timeframe required by law (generally 45 days, with a permitted extension). To appeal, reply to our decision and we will reconsider. California “Shine the Light” requests may be sent to the same address.
8. Global Privacy Control & Do Not Track
We honor the Global Privacy Control (GPC) browser signal as a valid opt-out of sale/share where applicable. Because there is no universally adopted standard for “Do Not Track” (DNT) headers, the Site does not respond to DNT signals differently; however, the Site sets no tracking cookies regardless.
9. Children's privacy
The Site is a business-to-business service intended for adults and is not directed to children. We do not knowingly collect personal information from children under 13 (or under 16 where applicable). If you believe a child has provided us information, contact us and we will delete it. (See COPPA.)
10. Retention & security
We retain personal information only as long as necessary for the purposes described here or as required by law, then delete or de-identify it. We use reasonable administrative, technical, and organizational safeguards to protect personal information; however, no method of transmission or storage is 100% secure.
11. International, EU & UK users
We are based in the United States and process information there. If you are in the EEA, UK, or Switzerland, our legal bases for processing are: your consent; performance of a contract or steps at your request; compliance with legal obligations; and our legitimate interests in operating and securing the Site. You have rights to access, rectify, erase, restrict, port, and object to processing, and to lodge a complaint with your supervisory authority. Where we transfer data internationally, we rely on appropriate safeguards (e.g., Standard Contractual Clauses). EU/UK representative: [EU/UK REPRESENTATIVE].
12. Changes to this policy
We may update this policy from time to time. We will revise the “Effective date” above and, for material changes, provide a more prominent notice. We will not materially change how we use your text-messaging or phone consent without obtaining new consent where the law requires it.
